Terms of Service

1. Acceptance

By creating a Churchy account or using the Churchy service ("Service"), you agree to these Terms of Service ("Terms"). If you are using Churchy on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Churchy provides an automated guest follow-up platform for churches, integrating with Planning Center to detect new guests and send personalized follow-up messages via SMS and/or email. The Service includes a web dashboard for managing guests, follow-ups, and integrations.

3. Your responsibilities

  • You are responsible for ensuring you have the right to contact guests via SMS and email under applicable law (including CAN-SPAM, TCPA, and GDPR where applicable).
  • You must not use Churchy to send spam, unsolicited bulk messages, or messages that violate any law.
  • You are responsible for the accuracy of any data you import from Planning Center.
  • You must keep your account credentials secure and notify us immediately of any unauthorized access.

4. Subscriptions and billing

Churchy is offered on a monthly subscription basis. You authorize us to charge your payment method on the first day of each billing cycle. Plans can be upgraded, downgraded, or cancelled at any time. Cancellations take effect at the end of the current billing period — we do not provide pro-rated refunds.

5. Acceptable use

You may not use Churchy to:

  • Send messages that are harassing, threatening, or discriminatory.
  • Impersonate another person or organization.
  • Reverse engineer, scrape, or attempt to access non-public parts of the Service.
  • Violate any applicable law or regulation.

We reserve the right to suspend accounts that violate these terms without prior notice.

6. Intellectual property

Churchy and its underlying technology are owned by us and protected by copyright and other intellectual property laws. These Terms do not grant you any right to use our name, logo, or branding without written permission.

7. Limitation of liability

To the maximum extent permitted by law, Churchy is provided "as is." We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost revenue, data loss, or failure of follow-up messages to be delivered. Our total liability to you will not exceed the amount you paid in the prior 12 months.

8. Termination

Either party may terminate the agreement at any time. We may terminate or suspend your account immediately if you violate these Terms. Upon termination, your access to the Service ends and we will delete your data within 30 days per our Privacy Policy.

9. Changes to these terms

We may update these Terms from time to time. We'll notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware.
